Terms and Conditions

These Terms and Conditions apply when you use maxgrow.uk or buy goods from us. Please read them together with our Shipping Policy, Return and Refund Policy and Privacy Policy. Nothing in these terms limits your statutory rights.

1. About us

2. Who these terms apply to

These terms apply to retail customers buying for personal use. If you buy for business, trade or resale purposes, any separate written trade terms agreed with us will also apply and take priority where they conflict with these terms.

3. Products and information

We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly between screens, and packaging may change without affecting the product’s essential characteristics. Product images are illustrative unless stated otherwise.

All products are subject to availability. We may correct genuine errors in descriptions or prices before accepting an order. This does not affect your rights where goods supplied are faulty, not as described or otherwise do not conform to the contract.

4. Prices and payment

Prices are shown in pounds sterling and include VAT where applicable. Delivery charges are shown separately before checkout. You must provide accurate billing and payment information and be authorised to use the selected payment method.

Promotions and discount codes may have additional conditions. Unless stated otherwise, only one discount code may be used per order and a promotion cannot be exchanged for cash.

5. Orders and contract formation

Submitting an order is an offer to buy. We will send an order acknowledgement, but a binding contract is formed only when we send confirmation that the order has been accepted or dispatched. We may refuse or cancel an order before acceptance, for example because an item is unavailable, payment cannot be authorised, the delivery address is outside our service area, or there is an obvious pricing or description error. If we have taken payment for an order we do not accept, we will refund it.

Please check your order and contact us promptly if anything is wrong. You may request cancellation before dispatch, but dispatch can happen quickly and cannot always be stopped. Your statutory cancellation rights remain unaffected.

6. Delivery

We currently deliver within the United Kingdom. Standard delivery is £9.99 for orders under £100 and free for orders of £100 or more. Our normal estimate is 2–4 business days from dispatch and approximately 3–6 working days from ordering. Full details and any area-specific restrictions are in our Shipping Policy.

Delivery dates are estimates unless we expressly agree a guaranteed date. We are responsible for the goods until they are delivered to you, or to a person you identify to receive them. If you independently arrange a carrier that we did not offer, risk passes when the goods are handed to that carrier.

If delivery is materially delayed, contact us. Your legal remedies, including the right to end the contract in circumstances provided by law, are not excluded.

7. Your right to cancel

If you are a consumer buying online, you normally have the right to cancel without giving a reason from the time the contract is made until 14 days after you, or a person you nominate, receives the goods. If one order is delivered in separate instalments, the period normally runs from receipt of the final item.

To cancel, tell us clearly by email, post or WhatsApp before the cancellation period ends. You may use the model cancellation form below, but you do not have to. After notifying us, you normally have a further 14 days to return the goods.

You are responsible for the direct cost of returning unwanted goods unless we agree otherwise or the goods are faulty, damaged or incorrect. You may inspect goods as you would in a shop, but we may reduce a refund to reflect loss in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.

We will refund eligible payments, including the cost of our least expensive standard delivery option, using the original payment method unless agreed otherwise. We may withhold the refund until we receive the goods or you provide evidence that you returned them. Refund timing and exceptions are explained in our Return and Refund Policy.

The right to cancel may not apply to goods made to your specifications or clearly personalised, perishable goods, or sealed goods not suitable for return for health-protection or hygiene reasons once unsealed, as provided by law.

8. Faulty, damaged or incorrect goods

Goods must be of satisfactory quality, fit for purpose and as described. If they are faulty, damaged, incorrect or otherwise do not conform to the contract, contact us as soon as possible with your order details. Your remedies may include rejection and refund, repair, replacement or price reduction, depending on the circumstances and applicable law. We will cover reasonable return costs where we are legally responsible.

9. Returns

Before returning anything, please follow the instructions in our Return and Refund Policy. You remain responsible for goods until they reach us, so use suitable packaging and retain proof of postage. This section does not reduce your statutory rights.

10. Website use and accounts

You must use the website lawfully and must not introduce malicious code, attempt unauthorised access, interfere with the website, misuse another person’s account, scrape the website in a way that materially disrupts it, or infringe intellectual-property or privacy rights. You are responsible for keeping your login details confidential and for information submitted through your account.

11. Intellectual property

The website and its original text, graphics, branding, layout and other content are owned by or licensed to us and are protected by intellectual-property law. You may view and use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute or commercially exploit our content without permission, except where law allows.

12. Third-party services and links

Our store is hosted by Shopify and may use third-party payment, analytics, delivery and communication services. Third-party websites have their own terms and policies. We are not responsible for third-party content, but this does not affect our responsibility for goods we sell or any liability that cannot lawfully be excluded.

13. Privacy

We process personal information as described in our Privacy Policy and Cookie Policy. Shopify and other service providers may process information to operate the store, payments and related services.

14. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

We are not responsible for losses that were not foreseeable when the contract was made, losses caused by your breach, or business losses suffered by a consumer. If you use products for business purposes, our liability is limited only to the extent permitted by law and any applicable written trade terms.

15. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect, keep you informed where appropriate, and perform our obligations as soon as reasonably possible. Your statutory rights concerning significant delay are unaffected.

16. Complaints

Please send complaints to sales@maxgrow.uk or contact us by telephone/WhatsApp on +44 7405 454074. Include your name, order number and a clear description of the issue. We will try to resolve complaints promptly.

17. General

If any provision is found invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. You may not transfer your rights under a contract without our consent, except where law allows. We may transfer our rights and obligations only where this does not reduce your rights.

No person other than you and us has rights under the contract, except where applicable law provides otherwise.

18. Governing law

These terms and contracts with consumers are governed by the laws of England and Wales. If you live elsewhere in the UK, you retain any mandatory protections of your home jurisdiction and may bring proceedings in the courts available to you under applicable law.

19. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version in force when your contract is formed. Material changes will be communicated where required by law.
